2. Description of Service

Earthasoft provides an agricultural monitoring and management platform that includes, but is not limited to:

Satellite imagery and remote sensing data analysis
Crop health monitoring and stress detection
Weather data integration and forecasting
Yield tracking and analytics
Agricultural data management and reporting
AI-powered agricultural insights and recommendations
Team collaboration and field management tools

The Service may be modified, updated, or discontinued at any time without prior notice.

3. User Accounts and Registration

To access certain features of the Service, you must register for an account. You agree to:

Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your password and account credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account
Not share your account credentials with third parties

You must be at least 18 years old to create an account. If you are creating an account on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

4. User Data and Content

You grant Earthasoft a non-exclusive, worldwide, royalty-free license to use, store, process, and display your User Content solely for the purpose of providing and improving the Service.

You are solely responsible for the accuracy, quality, and legality of User Content. You represent and warrant that you have all necessary rights to upload and use User Content in the Service.

4.3 Prohibited Content

You agree not to upload, post, or transmit any User Content that:

Violates any applicable laws or regulations
Infringes on intellectual property rights of others
Contains malicious code, viruses, or harmful software
Is fraudulent, misleading, or deceptive
Contains sensitive personal information of others without consent

4.4 Data Backup

While we implement reasonable data backup procedures, you are responsible for maintaining your own backup copies of important agricultural data.

5. Subscription Plans and Payment

5.1 Subscription Fees

Certain features of the Service require a paid subscription. Subscription fees are billed in advance on a monthly or annual basis, as selected by you.

5.2 Payment Terms

All fees are non-refundable except as required by law or as expressly stated in these Terms. You are responsible for all applicable taxes.

5.3 Auto-Renewal

5.5 Free Trial

If you are on a free trial, your subscription will automatically convert to a paid plan at the end of the trial period unless you cancel.

The Service may integrate with third-party services, including satellite imagery providers, weather data services, and mapping services. Your use of third-party services is subject to their respective terms and conditions and privacy policies.

We are not responsible for the accuracy, availability, or reliability of third-party data or services. Any reliance on such data is at your own risk.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

8.2 Agricultural Decisions

The Service provides agricultural monitoring, analysis, and recommendations for informational purposes only. You are solely responsible for all agricultural decisions, including but not limited to:

Crop selection and planting decisions
Irrigation and water management
Pest and disease management
Harvest timing and yield expectations
Compliance with agricultural regulations

8.3 Data Accuracy

While we strive for accuracy, we do not warrant that satellite imagery, weather data, or other information provided through the Service is error-free, complete, or suitable for your specific agricultural needs.

8.4 Limitation of Liability

To the maximum extent permitted by law, Earthasoft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of crops, loss of profits, or agricultural losses resulting from your use of or inability to use the Service.

9. Indemnification

You agree to indemnify, defend, and hold harmless Earthasoft, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party
Your User Content
Agricultural decisions made based on information from the Service

10. Termination

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

10.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without prior notice, if you:

Violate these Terms
Engage in fraudulent or illegal activity
Fail to pay subscription fees
Use the Service in a manner that could damage, disable, or impair the Service

10.3 Effect of Termination

Upon termination, your right to access and use the Service will immediately cease. We may delete your account and User Content, subject to our data retention policies. You may export your data before termination.
